PREAMBLE

These conditions are agreed between Woodtale, Lda and any individual of legal age or legal entity who wishes to make a purchase through the website. www.woodtale.com , telephone, mail or email, hereinafter referred to as “User”.
Orders will be shipped to mainland Portugal and, for some items, to Madeira and the Azores.
If the User resides outside the aforementioned delivery areas and wishes to have a delivery abroad, he/she can consult our Sales Department directly via email customerservice@woodtale.com .
The parties agree that their relations will be regulated exclusively by the general conditions described herein.
Woodtale, Lda is committed to respecting all current practices and laws in the e-commerce sector.

ARTICLE 1 – PURPOSE

The purpose of these conditions is to define the general sales conditions established between Woodtale, Lda and the User, from the moment of ordering to the various services provided by Woodtale, Lda and including payment methods and conditions for delivery of goods.
These conditions regulate all the steps necessary to place the order.

ARTICLE 2 – ORDER

Once we have verified your payment details and the Partner has accepted and approved your order for delivery, we will send you an email to let you know. In the unlikely event that we or the Partner encounter a problem processing your order, we will contact you and may ask for further information to try to resolve it.
The User may place his order online, at www.woodtale.com , by phone, by email or by post.

To place an order, the User must register on the website. www.woodtale.com , and to do so, you must provide certain personal data such as your name and address, among others. To this end, the User must complete all mandatory fields on the registration form. Once registration is complete, Woodtale, Lda services will assign you a customer number. You may only create one account on the website www.woodtale.com Users – individuals who are of legal age or legal entities.
If you are already a registered User, you must identify yourself by entering your email address or customer number, as well as your password.
The User may also register, obtain their customer number and place their order by telephone, in which case their personal data and order details will be collected by the telephone operator.
Validation of the order implies that the User has read and expressly accepts these General Conditions of Remote Selling, available for consultation at www.woodtale.com , as well as the prices and description of the products available for sale.
As soon as you complete your purchase, you will receive an automatic email confirming the transaction. If the data is not correct, you can immediately request that it be changed or even that the purchase be cancelled.
In the case of an order placed by telephone or by post, Woodtale, Lda will provide the consumer with the legally required pre-contractual information, including these general conditions for distance selling, via email sent the day after the order is placed, thus confirming the purchase and sale contract entered into with the User.
In the event of product unavailability, Woodtale, Lda undertakes to inform the User and reimburse any amounts paid within a maximum period of 45 (forty-five) days from the date of becoming aware of such unavailability.
Under the terms of Decree-Law No. 7/2004 of 7 January (with the amendments conferred by Decree-Law No. 62/2009 of 10 March and by Law No. 46/2012 of 29 August), relating to electronic commerce, Woodtale, Lda reserves the right to unilaterally cancel the order whenever there is a programming error or malfunction of Woodtale, Lda's computers, as well as if the contractual proposal arrives at its destination in a deformed state and the error concerns an essential element of the contract.

CANCEL ORDER:

If you need to cancel an order, you must contact us as soon as possible, by phone or email, so that we can try to cancel the order. Once the order has gone into production, it will not be possible to cancel it.

STATUS OF ASSETS:

Upon delivery of the goods, the customer or the person designated by him/her to receive the goods must confirm the external condition of the packaging, as well as ensure that all quantities mentioned have been received in order to, if necessary, report any non-conformity to the carrier. The Customer must, without fail, explain precisely any non-conformities or damaging situation, sign and date the receipt/delivery note. Woodtale, Lda cannot assume any liability towards the carrier if the note is not duly completed.

ARTICLE 3 – DELIVERY

Upon delivery of the products, the customer must confirm the external condition of the packaging and must sign the shipping guide/delivery receipt, communicating/writing the nonconformities or harmful situation, if applicable, with the carrier (e.g. damaged packaging, missing volumes, etc.). If you did not indicate the non-conformities at the time of delivery, Woodtale, Lda cannot be held liable in any way .

Orders can be delivered:

– At your home address or the address listed in your customer registration. If you are not at the address you provide, a postcard will be left or an SMS will be sent with the necessary instructions for rescheduling or collecting the appointment.

– At another address

Woodtale, Lda will deliver your order wherever you want (as long as it is accessible to the carrier/van/truck). Simply indicate the desired address on the order form or by telephone to our assistants.

IMPORTANT: Don't forget to keep your details updated in your customer area (telephone number, full address, etc.). At the time of dispatch from our warehouse, if your order exceeds 10 kg, or if the Delivery Point is not available to receive the order (temporary closure, etc.), it will automatically be sent to the address that appears in your customer account.

The estimated delivery time for any product is 4 to 12 weeks, and may be longer due to logistical delays resulting from the COVID-19 situation.

ARTICLE 4 – PAYMENT

– By credit card (Visa and Mastercard/American Express):
Your order and card details will be sent, duly encrypted, to the bank on the date of your order.

– With ATM:
When you choose this payment method, you will receive an SMS and an email with the payment details to make the payment at an ATM or via online home banking. After receiving the details, you have 3 days to make the payment. If you do not make the payment within this period, the order will be cancelled.
In cases where payment has been made and Woodtale, Lda needs to make a refund (cancellations at customer request, stock shortages, etc.), the refund will be made by bank transfer (the user must have the IBAN specified in the customer area).

– With MB WAY:
With MB WAY you can pay for your order quickly and conveniently using your smartphone, all you need is an MB WAY account. MB WAY orders will only be processed after payment confirmation. For more information or to find out how to create an account, visit this page: https://www.mbway.pt .
If payment is not made within the stipulated period, or if for some technical reason the amount is refunded to your MB Way account, the order will be considered cancelled.
In cases where payment has been made and Woodtale, Lda needs to make a refund (cancellations at the request of customers, stock shortages, etc.), the refund will be made by bank transfer (the user must have the IBAN specified in the customer area).

ARTICLE 5 – PRICES

Prices are in euros, with taxes and duties included. The prices shown take into account the VAT applicable on the invoice date. Any change in the applicable VAT rate will be reflected in the prices of the products.
Prices and specifications are subject to change without notice. However, once the order has been validated, prices cannot be changed in any way.

ARTICLE 6 – EXCHANGES & RETURNS

Right of Free Termination/Right to Withdraw

The User may choose to freely terminate the contract, under the applicable legal terms. In order to exercise his/her right of free termination, the User must communicate his/her decision to terminate this contract by post or email to customerservice@woodtale.com .
In order for the free resolution period to be respected, it is sufficient that your communication regarding the exercise of the right of free resolution is sent to Woodtale, Lda before the end of the resolution period of 14 calendar days from the date of delivery of the goods.

Important: All return costs are the sole responsibility of the User.

In case of termination of this contract, the User must return the goods without undue delay and within 14 (fourteen) days from the day on which he informed Woodtale, Lda of the free termination of the contract.
The User must return the items and in good condition, in the original packaging and accompanied by the original invoice ; the return costs will be the sole responsibility of the customer. In the case of bulky items, which due to their weight and volume characteristics are not accepted at the Pick-up network points, the User may contact a carrier of their choice.

Exchange and Return Conditions:

Returns of products are only possible for standard items and that are not produced to order.

Woodtale, Lda hereby informs that it may withhold the refund until it has received the returned goods, or until the User presents proof of sending the goods, whichever occurs first.
Return of items (without defects) in good condition/never used, in its original packaging and accompanied by the original invoice will be the responsibility of the User to the following address: Rua 1º de Maio number 66, 4585-781 Vandoma.
Woodtale, Lda is only responsible for return and reshipment costs if there is an internal error and the product sent does not correspond to the order or if the product has original defects.
When returning or exchanging items, the User must respect the following conditions:
Return of items in good condition/never used, with complete original packaging and accompanied by the respective original invoice, the duly completed return slip and without any signs of use. All items will be checked upon arrival at our facility and Only those that comply with the return conditions will be accepted for exchange or return .
In the event of returning all items, if the order has given the User the right to a gift, this gift must also be returned.
In the event of a refund request for an item purchased at a reduced price, due to a special offer, Woodtale, Lda will refund the amount actually paid by the User and not the full amount.
Other Return Conditions: if the product sent does not correspond to the order, if it has original defects or has been damaged during transport (the damage must be noted at the time of delivery on the transport note) or if there is an internal error by Woodtale, Lda.
In the case of bulky items, the customer must send the following email address: customerservice@woodtale.com , photographs that may illustrate the error, anomaly or condition of the goods. Any damage visible at the time of opening the packaging, caused by poor or insufficient packaging, must be photographed before assembly with the original packaging.

When a refund is due, Woodtale, Lda will proceed as follows:

Regardless of the payment method used for your purchase, refunds resulting from returns, where there is at least one item to be exchanged and/or exchange value adjustments, will always be made to the IBAN.

ARTICLE 7 – WARRANTY & AFTER-SALES ASSISTANCE

LEGAL GUARANTEE

Under current legislation (Decree-Law No. 67/2003, of 8 April, with amendments introduced by Decree-Law No. 84/2008, of 21 May), all products sold in www.woodtale.com are covered by a guarantee of conformity of goods corresponding to a period of two years from the delivery of the goods for private customers. In accordance with the provisions of Article 916 of the Civil Code, for professional customers, the complaint of the defect or lack of quality of the article must be made within thirty days of becoming aware of the defect and within six months after delivery of the product.

If the purchased product is defective or faulty, the User must report the situation to Woodtale, Lda's User Support Service, providing their order number and a description of the defect or malfunction by:

Shipping costs for defects will be borne by Woodtale, Lda. After receiving the item at Woodtale, Lda's facilities, it will be checked and, if any lack of conformity is proven, the item will be repaired or replaced, if repair is not possible. In this case, Woodtale, Lda will send the repaired item or the new item to the User's address at no additional cost.
If the item is no longer available and cannot be repaired, Woodtale, Lda will refund the User the amount paid for it.
Based on verification carried out by Woodtale, Lda, or by the brand itself, the warranty does not cover signs of wear, misuse and/or any problem that may have caused the defect or malfunction of the item (for example: falling, humidity, etc.).

ARTICLE 8 – SIGNATURE AND PROOF

The User number is strictly personal. If you lose or forget this number, you must report it to the User Support Service on 222 403 936 or customerservice@woodtale.com .
The online indication of the bank card number and the final validation of the order will constitute proof, in accordance with the legal provisions, and will allow the demandability of these amounts.
Validation of the purchase order implies that the User has read and expressly accepts these General Conditions of Remote Selling, available for consultation at www.woodtale.com .
The data recorded by Woodtale, Lda constitutes proof of the set of transactions carried out between Woodtale, Lda and the User. It is the responsibility of Woodtale, Lda to archive the electronic document in which the contract is formalized and keep it accessible.

ARTICLE 9 – LIABILITY

All Products sold on the website www.woodtale.com are in compliance with Portuguese legislation.
Woodtale, Lda is not responsible for losses resulting from interference, interruptions, computer viruses, faults or disconnections of the operating system that may temporarily prevent access, navigation or the provision of services to the User.
Woodtale, Lda declines any responsibility for any delay or impossibility in processing the order, particularly at the time of delivery, resulting from an error or insufficiency of the data communicated by the User. Likewise, Woodtale, Lda cannot be held responsible if the failure to comply with its obligations is attributable to an unforeseeable or insurmountable fact of a third party or is a case of force majeure.

The items sold are described and presented on the website with the greatest possible accuracy. If, despite all our precautions, errors occur on the website or in the catalogues of Woodtale, Lda, Woodtale, Lda will not be held liable for this fact. Except in the case of a guarantee, any transaction between Woodtale, Lda and its Users that is not disputed within a period of six months will not be able to give rise to any claim.

It is the customer's sole responsibility to keep their Customer account details correct and up to date, through the Customer Area on our website, or through our Customer Support service.

ARTICLE 10 – PROCESSING OF PERSONAL DATA

The processing of personal data collected on the website www.woodtale.com is the responsibility of Woodtale, Lda.
The data collected on this website is necessary for the conclusion and execution of the purchase and sale contract, and is intended for processing orders and communicating with the User, processing requests for information and any complaints, statistical analysis and satisfaction assessment. Providing the information requested as part of the User's registration is mandatory and the User guarantees that the information provided is true.
Woodtale, Lda guarantees the confidentiality of all data provided by the User and ensures that it is kept for a period of five years from the last contact with the User. Nevertheless, Woodtale, Lda collects and processes data securely and prevents its loss or manipulation, using the most advanced techniques for this purpose. If the collection of this personal data occurs on an open network, we inform you that this allows the circulation of personal data without security conditions, running the risk of being seen and used by unauthorized third parties.
If the User gives his/her express consent at the time of creating or changing his/her registration, Woodtale, Lda may send information about products and services that may be of interest to him/her using his/her personal data for direct marketing purposes through any communication channel, namely through the use of email, SMS, MMS or other forms of automatic calling, including sending the Woodtale, Lda Newsletter.
If the User gives his/her express consent at the time of creating or changing his/her registration, Woodtale, Lda may use his/her personal data to define his/her profile based on his/her preferences in order to adapt the proposals and communications addressed to him/her.

Woodtale, Lda has a “Chat” service in which users can ask questions to customer support. If users provide personal data to Woodtale, Lda through said Chat, such data will not be used for any purpose other than that requested by the User.
The Customer is granted, provided that he/she is duly identified, the right to access personal data concerning him/her, as well as its rectification or erasure, and the limitation of processing, or the right to object to processing, as well as the right to data portability. The User has the right to withdraw consent at any time with regard to the processing of his/her personal data for direct marketing actions. He/she may exercise his/her rights through the following means:

ARTICLE 11 – INTELLECTUAL PROPERTY

All elements of the Woodtale, Lda website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of Woodtale, Lda.
Therefore, and in accordance with the Copyright and Related Rights Code, its use is only authorized for private purposes, without prejudice to more restrictive provisions contained in the aforementioned Code. Any reproduction or representation, in whole or in part, of the website www.woodtale.com or of all or part of the elements included therein is strictly prohibited, and must be subject to prior written authorization from Woodtale, Lda, under penalty of recourse to the competent legal means against anyone who acts in this way.
Any User who has a personal website on the Internet and wishes to place, for personal use, a simple direct hyperlink to the homepage of the Woodtale, Lda website on his/her website must request authorization from the company Woodtale, Lda. In this case, there will be no implicit agreement of affiliation or partnership.
On the other hand, any hypertext directed to the Woodtale, Lda website and using the framing or in-line linking technique is formally prohibited.
In all cases, any hyperlink, even tacitly authorized, must be removed upon a simple request from Woodtale, Lda.

ARTICLE 12 – APPLICABLE LAW AND JURISDICTION

The sales conditions presented are subject to Portuguese law.
To resolve any dispute, there is always the possibility of resorting to an arbitration entity.
The European Union has created a website to support consumers in submitting their complaints about any dispute in which they are involved. In this context, Woodtale, Lda provides all the information so that you can exercise your right to complain to an official, third-party and impartial entity in the process, which will help you resolve the dispute in question. In the absence of resolution by agreement between the parties, any dispute arising from these General Conditions of Sale will be submitted to the competent Portuguese court.
